Overview

This Data Policy describes how WeatherAds processes Customer Data when providing services to our customers. This Data Policy explains who we are, what we do, what data we have access to, how we access these data, and what we do with these data.

Our Principles

  • We process and store data that are generated when our customers run weather targeting in conjunction with their ad campaigns in order to produce reports and track campaign spend information for the benefit of that customer.
  • We do not know - and will not attempt to know - the identity of any individuals engaged with viewing or clicking on campaign ads.
  • We do not know - and will not attempt to know - detail relating to audience lists a customer campaign is targeting.
  • We do not have access to any personally identifiable information (PII)

What We Do

We provide services to our customers that allow them to optimize their digital advertising based on weather signals. We are a service provider to our customers and do not have a direct relationship with our customers targeted audience or the visitors to our customers websites.

Nature of the WeatherAds Services

The WeatherAds platform offers the ability to apply a weather triggered component to campaigns being run through Google Ads, Facebook Ads and Google Video & Display advertising platforms. Actions are triggered at a broader location level and not targeted at audience individuals. For example, our customers can use WeatherAds to switch on a campaign based on weather for a certain city, or bid up or bid down based on the weather in a certain zip-code. Our targeting actions are always based at the geo-level. We don’t have access to, and will never try to access data that might be able to personally identify an individual.

Authorization for platform Sync

In order for WeatherAds to operate we require that our customers authorize (sync) their ad platform account with the WeatherAds application. This authorization process is necessary as it grants permissions for WeatherAds to change certain settings within a customer’s campaigns to apply the customers desired weather targeting. This is done through the ad platform’s API service. It also allows WeatherAds to access information for campaigns being run through the authorized account. Following are the official links from the ad platforms we work with describing what it means to provide WeatherAds with authorization through the sync process:

Data Types WeatherAds Accesses and Stores

WeatherAds only ever accesses or downloads data relating to campaigns that have been specifically selected by a customer to have live weather targeting applied. We do not and will not access any data for campaigns or any other data that has not been ‘imported’ by the customer into WeatherAds for weather targeting purposes. The main types of data we access and store may include (but are not ultimately limited to) the following;

  • Geo Locations
  • Campaign Type
  • Budget & Bid Strategies
  • Ad Creative
  • Campaign Spend
  • Performance Metrics

These data types are required to effectively support the weather targeting process, to provide customers with summary information and reporting within the WeatherAds platform, and to enable WeatherAds to charge the appropriate amount for the service used by customers.

Storing of data

WeatherAds uses Amazon Web Services (AWS) to host the WeatherAds application and store Customer Data relating to the service it provides (see https://aws.amazon.com/security). Customer Data is held securely with every effort made to ensure the data is protected from access by unauthorized parties. WeatherAds only stores Customer Data necessary to run the weather targeting on behalf of the customer and only continues to store data that allows a customer to access a historic record of their weather targeting activity.

Service Providers

We may engage certain trusted third parties to perform functions and provide services to us, including, without limitation, data center hosting and telecommunications. However, this is done only to the extent necessary for these third parties to perform the functions, and provide the services that we have purchased from them. In all cases, these services are completed only pursuant to binding contracts requiring such third parties to maintain the privacy and security of Customer Data to which they have access and to not use it for any other purpose.

To Defend or Enforce our Rights

We may use or share data to protect ourselves or protect the WeatherAds website, to establish or exercise our legal rights, respond to a breach of our Website Terms and Conditions or Subscription Services Terms of Use, when we believe it is appropriate to protect the property and rights of WeatherAds or a third party, the safety of our company, our customers or others, to investigate, prevent, take action against, or stop any fraudulent, illegal, unethical, or legally actionable activity, in connection with our Site, and WeatherAds Services.

Business Transfers

If any or all of the assets of WeatherAds are acquired by, or merged with another entity, or in the unlikely event of a bankruptcy, we may disclose, share or transfer some or all of the Customer Data to or with the actual or potential successor entity in preparation of the transaction, as part of the due diligence, or after the transaction has been consummated, so that the successor entity can continue providing our services to our customers.

Compliance with Laws and Third Party Requests

WeatherAds cooperates with government and law enforcement officials or private parties to enforce and comply with the law, as required by applicable law. We may disclose Customer Data to government or law enforcement officials or private parties as we, in our reasonable discretion, believe necessary or appropriate to respond to legal process, respond to and defend against legal claims, or otherwise as required by applicable law.

After Aggregating Data Across Groups of Customers

WeatherAds may aggregate data in order to obtain statistical information about trends in digital marketing campaigns. We then analyse this aggregated data and may at time publish reports that are then used for industry analysis, demographic profiling, sales, marketing, and other business purposes. These reports provide information in aggregate form only. No customer or specific campaign is or may be identified from these reports.

Right to Object to New Uses of your Customer Data

If at any time we wish to disclose, or use your Customer Data in a way, or for a purpose that is materially different from that which is described in this Data Policy, we will give you the opportunity to choose whether Customer Data that identify you or from which you may be identifiable may be used for a purpose other than the purposes that are set forth in this Data Policy.

Use of Customer Data for Marketing

Under this Data Policy we will not share any Customer Data with third parties for direct marketing purposes. If at any time we wish to disclose, or use such data in a way, or for a purpose other than as described in this Data Policy e.g. for use in a case study, we will specifically request consent from the customer to the end that specifically agreed upon data may be used for a purpose other than the purposes that are set forth in this Data Policy.

Accessing, Changing, or Deleting Customer Data

At any time, a customer can request, in writing, WeatherAds delete any or all Customer Data held on behalf of that customer. WeatherAds will endeavor to delete this data within 10 working days of receiving the written request.

Security

WeatherAds employs administrative, physical, and electronic measures designed to protect customer data from unauthorized access, loss, misuse, disclosure, alteration, and destruction. While we do our best to implement security measures, we do not guarantee that our safeguards will always work.

When we need to transfer customer data out of our firewall, we use industry-standard technological means to protect all customer data while in transit through the Internet. We use encryption and a comprehensive authentication protocol to provide reasonable security. However, please remember that no security system on the Internet is perfect.

Payment Processing

For credit card payment processing we use a third party payment processor, Stripe (www.stripe.com). Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry. At no time does WeatherAds have access to or sight of any credit card information that could compromise the security of the credit card.

Disclaimer, Exclusion, and Limitation of Liability

WeatherAds makes no representations or warranties about the suitability, reliability, availability, timeliness, security, or accuracy of the site, services, or data made available from the services. Your use of the site or services, and all content, material, and third party software and content are at your sole responsibility and risk. The site and services are provided on an “as is” and “as available” basis.

WeatherAds disclaims any warranty that the site, the services, or any content, including, without limitation, any third party software and content, will meet your requirements or be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the site, services, and servers are free of viruses or other harmful components. You agree that from time to time WeatherAds may remove the site or cease providing the services for indefinite periods of time without prior notice or notification. Your access to and use of the site and services may be interrupted or suspended from time to time for any reason, including, but not limited to, equipment malfunctions, periodic updating, maintenance or repair of the site or services, or other actions that WeatherAds, in its sole discretion, may elect to take. You acknowledge and agree that you are not entitled to damages or any other form of compensation or relief when outages, delays, downtime, malfunctions, security or system breaches, or other interruptions of service occur.

WeatherAds makes no guarantee regarding: (a) the number of visitors, views, conversions, cost or performance of any of your campaigns, ads or landing pages; or (b) the compatibility of any software, hardware, or content with the site or services. You are not entitled to compensation, refunds, credits, damages or any form of relief should the site or services not meet your expectations.

You are solely responsible for ensuring that your content is compatible with the site and/or services. WeatherAds disclaims any liability or responsibility for any unauthorized use of your content by third parties or other users of the site or services, and is not responsible for protecting your content.

WeatherAds is not responsible for the acts, omissions, or failures of any third-party content, service, network, or software or hardware provider, including but not limited to, internet service providers, hosting services used by WeatherAds, telecommunications providers, content provided by other users, or any software or hardware not provided by WeatherAds.

Any material downloaded or otherwise obtained through the use of the site or services  is done at your own discretion and risk. You agree that you, solely, are responsible for any damage to your computer system or other device, and/or for any loss of data that may result from the download of any such material.

No advice or information, whether communicated orally or in writing, from WeatherAds employees, or via the site or services, shall create any warranty not expressly stated in this agreement.

The site and services are offered and controlled by WeatherAds from its facilities in the UK. WeatherAds makes no representations that the site or services are appropriate or available for use in other locations. Those who access or use the site or services from other jurisdictions do so at their own risk and are responsible for compliance with local law.

You agree that neither WeatherAds nor its owners, officers, directors, affiliates, contractors, licensors, employees or agents, will be held liable to you or any third party acting on your behalf, for any tangible or intangible damages or losses arising from or relating to: this agreement, your use of or inability to use the site or services, or your use of third party materials, content, or services.

WeatherAds will not be held responsible for any damages, liabilities, losses, or other consequences that you may incur in the event that the site and/or services are modified, suspended or discontinued.

In no event shall WeatherAds’s and its affiliates’, representatives’, officers’, directors’, stockholders’, employees’, or agents’ aggregate liability for all claims, whether in contract, tort, or any other theory of liability, exceed the cost of customer’s subscription.

Disputes

If you have any concerns or claims with respect to our Data Policy, please contact us as indicated in the “How to Contact Us” section. We will investigate and attempt to resolve any complaints and disputes regarding our use and disclosure of customer data. If arbitration is necessary, it will be conducted under English law.

Updates

This Data Policy may be updated from time to time for any reason. We will notify you of any material changes to this Data Policy by posting the new Data Policy on the Site, and as required by applicable law. To the extent that this is technically feasible, we will obtain the necessary consents required under applicable law if we seek to collect, use or disclose Customer Data for purposes other than those described above, unless this change is otherwise required or permitted by law.

Except as stated above, all changes will apply to the Customer Data that are already collected, and to Customer Data that are collected after the effective date of the revised policy. You are advised to consult this Data Policy regularly for any changes.
